Conflicto de competencia suscitado entre el Juzgado Civil Municipal de Ubaté y Juzgado Cuarto de Ejecución Civil Municipal de Medellín.
La controversia entre las autoridades involucradas se generó en torno a las diferentes interpretaciones del factor territorial.
Luego de analizar las diferentes argumentaciones que presentaron los operadores judiciales la Corte determinó que, en virtud del criterio a “prevención” establecido por la ley para el factor territorial, corresponde al juzgado del municipio de Ubaté conocer del asunto, pues los accionantes escogieron presentar la solicitud en dicho ente territorial.
Se ordena remitir el expediente al precitado despacho para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

DEJAR SIN EFECTOS el auto del 10 de junio de 2020, que profirio el Juzgado Civil Municipal de Ubate, mediante el cual se declaro sin competencia para conocer de la accion de tutela formulada por el senor Jorge W. Villamil Gomez, agente oficioso de los senores Maria Lilia Canon Becerra y Fabio Humberto Paez Canon, contra la representante legal de FRACOR S.A.S.
- Segundo. REMITIR el expediente ICC-3857 al Juzgado Civil Municipal de Ubate para que, de manera inmediata, tramite y adopte la decision de fondo a que haya lugar.
- Tercero. Por Secretaria General, COMUNICAR al accionante y al Juzgado
- Cuarto. de Ejecucion Civil Municipal de Medellin la decision adoptada en esta providencia.
